Darley Dale Cricket Club Disciplinary Procedure

Scope

This procedure applies to all players and members of Darley Dale Cricket Club.

Matters to be dealt with under this procedure:

  • breach of  the Club Code of Conduct on or off the field of play;
  • breach of the England and Wales Cricket Board Code of Conduct and Derbyshire County Cricket League Code of Conduct;
  • breach of Derbyshire County Cricket League Rules.

Disciplinary Panel

The Disciplinary Panel shall be chosen, as required, from the Management Committee of the Club as follows and the Panel shall elect a Chairperson for the meeting:

  • up to three members of the Management Committee;
  • the Club Secretary acting in a secretarial capacity;

Appeals Panel

The Appeals Panel shall be chosen, as required, from the Management Committee of the Club as follows and the Panel shall elect a Chairperson for the meeting. None of those chosen, other than the Secretary, shall have served on the Disciplinary Panel for the original hearing:

  • up to three members of the Management Committee;
  • the Club Secretary to act in a secretarial capacity;

The Disciplinary Procedure

Any matters relating to a breach of discipline to be reported to the Club Secretary.

The Secretary shall call a meeting of the Disciplinary Panel within seven days of receiving a report.

The result of the disciplinary meeting shall be communicated in writing to all parties concerned, within seven days of the meeting. The Derbyshire County League, or any other external body concerned, will also be informed of the outcome if appropriate.

If an appeal is to be lodged, the Secretary must be informed of this in writing within seven days of receipt of the result of the disciplinary meeting.

The Secretary shall call a meeting of the Appeals Panel within seven days of receiving the appeal.

The result of the appeal shall be communicated in writing to all parties concerned within seven days of the meeting. The Derbyshire County League, or any other external body concerned, will also be informed of the outcome if appropriate.

If a member does not attend a scheduled Disciplinary or Appeal meeting without providing a good reason for his/her absence then the meeting will proceed in his/her absence.

Any member due to appear before the Disciplinary or Appeals Panel may request an adjournment, if they have good reason for being unable to attend on the scheduled date, of up to fourteen days. Every attempt will be made to agree a date convenient to the member but in the event this is not possible within this time period then the meeting will proceed in the absence of the member.

Any member appearing before either Panel will be entitled to be assisted by another person if he/she so wishes.

If the member due to appear before either Panel is under the age of 18 years on the date of the hearing, then that member will be required to be accompanied at the meeting by a responsible adult. If the member is unable to provide a responsible adult then one will be appointed by the Management Committee to provide advice and guidance. If the appointed person is also a member of the Management Committee then he/she will not be eligible to sit on either the Disciplinary or Appeals Panel in relation to that member’s case.

Guidance for Disciplinary and Appeals Panels

In deciding the result of any meeting, including fines or penalties, the Panel shall consider the guidelines laid down in Section 4 Category 1.1 to 1.4 of the Policy and Procedure for Handling Discipline currently being used by the Derbyshire County League.
